NEW WAVE ACADEMY TRAINING CENTRE – LIABILITY WAIVER & MEMBERSHIP AGREEMENT

1. ASSUMPTION OF RISK & RELEASE OF LIABILITY
I, the undersigned, acknowledge and fully understand that participation in martial arts and associated fitness training at New Wave Academy Training Centre (NWA) involves inherent and significant risks of physical injury, including but not limited to: sprains, strains, broken bones, dislocations, concussion, and in extreme cases, permanent disability or death.
I understand these risks apply to all disciplines offered by NWA, including but not limited to:
I confirm that I am in good health, both physically and mentally, and I am capable of safely participating in physical activities. I understand that it is my responsibility to inform instructors of any injuries, medical conditions, or limitations prior to training.
By signing this waiver, I voluntarily accept all risks associated with participation and agree to assume full responsibility for my own safety.
I hereby waive, release and discharge New Wave Academy, its owners, staff, instructors, representatives, affiliates, volunteers, insurers, and agents from any and all liability for personal injury, death, property damage or loss, however caused, including negligence, arising from or in connection with participation in training, classes, or any NWA-related activity or event.
This release applies to myself, my heirs, executors, administrators, and assigns.
2. INSURANCE REQUIREMENT
All members are required to pay a £20 annual member-to-member insurance fee, which provides liability cover in cases of gross negligence or criminal behaviour between members during training. This insurance is provided via the UKBJJA (United Kingdom Brazilian Jiu-Jitsu Association). It does not cover personal injury, which remains the participant’s responsibility.

3. PHOTOGRAPHY & MEDIA CONSENT
New Wave Academy may take photos and videos during classes, events, or training for promotional, educational, or social media purposes (e.g., Instagram, TikTok, Facebook, YouTube, website).
By signing this waiver, I grant NWA full rights to use my image, voice, and likeness in these materials without payment or further consent. I understand the content may be edited and used across public platforms.

4. MEMBERSHIP CONTRACT TERMS
This agreement forms a contract between the Member and New Wave Academy. By joining NWA, you agree to the following terms:

Minimum Membership Commitment: 3 months from the date of registration.

Cancellation: Requires 30 days’ written notice via email or in person.

Fees: Membership fees are payable in advance on a monthly basis.

Payment Methods: Accepted forms include direct debit, bank transfer, debit card, or cash (by prior agreement).

Access: Members may access the facility during standard operating hours.

Termination: NWA reserves the right to cancel membership in cases of breach of rules, misconduct, or non-payment.

Changes: NWA reserves the right to amend the terms and will notify members in writing of any changes.

Refunds: No refunds will be issued for cancellations during the 3-month minimum term or on discounted long-term plans (e.g., 6- or 12-month upfront payments).
5. AGREEMENT
I have read, fully understood, and voluntarily agree to the terms and conditions of this waiver and membership contract. I acknowledge that I have been advised to seek independent legal advice if I have any concerns or do not fully understand the terms.
